 These Terms of Use (“TOU”) constitute the agreement ("Agreement") between Digifonica International Inc. (“Digifonica”), and you ("visitor," "partner," "subscriber," or "investor"), pertaining to Digifonica’s Internet telephony network and solutions, mobile telephony solutions (VoWiFi), connectivity equipment (including IP phones and analog telephone adapters), and website or other marketing tools.
By reading these TOU or using our network, solutions, equipment, or services, you acknowledge that you are of legal age to enter into a service agreement with Digifonica and that you have read and fully understood the terms and conditions outlined in the TOU.

All information on the Digifonica website including partner and investor information, white papers, and information about Digifonica’s Internet telephony framework is deemed the copyright of Digifonica International Inc. and is proprietary to Digifonica. No part of this information may be reproduced, disseminated, or sold in any form without the express written consent of Digifonica International Inc. Digifonica reserves the right to update the “Terms of Use“ at any time without prior notification to parties external to Digifonica. Digifonica also reserves the right to update web content or typographical errors at any time without notifying any external party.
While the information on this website is current and updated regularly, neither Digifonica nor its partners, investors, and suppliers are liable for direct or indirect losses resulting from the non-validated use or citation of information on this website. Digifonica reserves the right to update these TOU at any time with no prior notification to any party external to Digifonica.

Any misuse, misrepresentation, or reproduction of the information on this website is subject to legal action. Furthermore, the use of Digifonica-patented technology in similar products is prohibited by law and will lead to serious legal consequences.
Potential partners evaluating Digifonica’s services may use excerpts of information from Digifonica’s website in their internal collateral provided the following conditions are met:

  1. The information is for internal evaluation purposes only and is not circulated beyond a restricted group of stakeholders.

Digifonica’s Services and Products

Digifonica offers a range of Internet telephony and mobile WiFi telephony (VoWiFi) solutions. Our Internet telecommunications technology solutions comprise a network, configurable components, software, and hardware. Every product or service obtained from Digifonica is governed by the Service Level Agreements (SLAs) and contracts specific to the service or product. Neither Digifonica nor its partners, suppliers, employees, or investors are liable for losses resulting from services or products wherein, explicit agreement is not documented in a valid SLA. You acknowledge that if you make a payment for an Internet telephony service where the end user of the telephone service is a different individual, you will share these TOU and all relevant partner legal notices with the actual end user. 


I. Emergency Phone Services

Subscribers on the Digifonica Internet telephony framework are able to access emergency services in the relevant country (911 in North America or 112/999 in UK), unless otherwise specified on a partner website or in partner services collateral. However, it is highly recommended that subscribers do not adopt Internet telephony services as their primary telephony service. Subscribers are urged to have a primary traditional landline or mobile phone for emergency calling. Digifonica is not responsible for any claims arising from subscribers being unavailable to dial emergency services, since adequate and prominent information is provided to the customer at every stage of the pre-sales and post-sales process. In instances where emergency calling is offered by our partners, the subscriber is responsible for providing and updating their emergency location information each time they move to a new location. Digifonica cannot accept responsibility for any failure to update personal information.

You authorize Digifonica and/or its partners to share the location information you have provided with the requisite emergency authorities or operators in the event we are contacted. You also acknowledge that you will notify all users of the phone service about emergency calling procedures. Digifonica is not liable for any losses or damages resulting from your failure to notify family or friends who will use the Internet telephony service. In addition, Digifonica is not responsible for the failure of any emergency procedures or services received once you connect to an emergency operator.

As Digifonica develops further features to enhance emergency access, these TOU will be updated as will all collateral shared with partners and subscribers.

II. Service Outages

Emergency calling and regular services will not be available in the event of a power outage or disruption in supply, or in the event your broadband connection fails. In addition, closure of your Internet telephony account with a partner will result in the inability to make any calls including emergency calls until you add funds or reopen your account. Data network failures during high-bandwidth times might lead to disturbances in emergency calls. Hence, be sure to have a primary traditional landline or mobile phone available to make emergency calls.

III. Fair Use of Services

By signing up for an Internet telephony service with a partner, you hereby acknowledge that the service will be used only on one fixed and one mobile computer, and that the service will not be shared, sold, or transferred to any party without the express written permission of Digifonica or its partners. You will not use the service for unlawful or inappropriate activities (including threats, harassment, impersonation, identity theft, and privacy-invasion). Any unlawful use is subject to severe legal action. In addition, you will be responsible for all fees and damages resulting from unlawful conduct. Digifonica and its partners reserve the right to immediately terminate services or contracts with individuals found to be violating these TOU or other legal regulations.

IV. Geographic Nature of Service

If a nomadic user, you acknowledge that you are aware that the quality and availability of internet telephony services might be affected by your geographical location.

V. Number Portability

Digifonica’s number portability provisions are compliant with the relevant regulatory requirements for specific geographical service regions.

VI. Directory Listing

Telephone numbers provided by Digifonica partners will not be listed in a telephone directory. You will also not be able to access other subscribers’ numbers from a common directory.

VII. Technical Support

Technical support being provided by Digifonica is subject to partners having opted for a support service for subscribers. The extent of support depends on individual Service Level Agreements (SLAs). Unless a contract or SLA for support has been signed, Digifonica reserves the right to modify the Technical Support procedures, guidelines, or availability at any time with no prior notification to any external party.
